ENG Properties (“ENG Properties,” “we,” “us,” or “our”) is a San Diego–based property management and real estate brokerage. We respect your privacy and are committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect, how we use and share it, and the choices you have, when you visit our website, contact us, apply to rent or lease, become an owner client or tenant, or communicate with us by text message.
By using our website or services, or by providing your information to us, you agree to the practices described in this Privacy Policy.
Information We Collect
We collect information in several ways, including information you provide directly, information collected automatically, and information from third parties.
Information you provide to us
- Contact information — such as your name, mailing address, email address, and phone number.
- Rental and application information — if you apply to rent a property, we may collect information needed to process your application and screening, such as your date of birth, Social Security number, government-issued ID, income and employment information, rental history, and references.
- Owner and client information — if you are a property owner or prospective client, we may collect business and financial information needed to manage your property or provide brokerage services, such as banking details for owner disbursements and property ownership records.
- Transaction information — records related to leases, rent payments, maintenance requests, and other services we provide.
- Communications — the content of emails, text messages, voicemails, web form submissions, and other communications you send to us.
Information collected automatically
When you visit our website, we may automatically collect certain information about your device and browsing activity, such as your IP address, browser type, operating system, the pages you view, and the dates and times of your visits. We may use cookies and similar technologies to operate and improve our website.
Information from third parties
In connection with rental applications and our property management services, we may receive information about you from consumer reporting agencies, background-check and screening providers, credit bureaus, prior landlords, and employers, as permitted by law.
How We Use Your Information
We use the information we collect to:
- Provide, operate, and improve our property management, leasing, and brokerage services;
- Process rental applications, tenant screening, leases, and rent payments;
- Communicate with you about your application, tenancy, property, maintenance requests, or owner account, including service updates, reminders, and alerts;
- Respond to your inquiries and customer-service requests;
- Operate, maintain, and improve our website and text messaging services;
- Comply with applicable laws, regulations, and legal processes, and protect our legal rights and the rights and safety of others.
Text Messaging (SMS) Communications
ENG Properties uses a business text-messaging service to send and receive text messages through our office line. This section explains how our SMS program works and how we handle the information involved.
Opt-in and consent
By providing your mobile phone number to ENG Properties and agreeing to receive text messages — for example, on an application, web form, lease document, or by texting us first — you consent to receive text communications from us at that number. These messages may include responses to your inquiries, appointment and showing coordination, maintenance and service updates, account and rent-related notices, and other communications related to our services. Message frequency varies. Message and data rates may apply.
Opt-out
You can opt out of text messages at any time by replying STOP to any message you receive from us. After you opt out, we will not send you further text messages unless you opt back in (for example, by replying START). For help, reply HELP or contact us using the information in the “Contact Us” section below.
How we handle your mobile information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of information sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We may share your mobile information with trusted vendors that help us operate our text messaging service (for example, our messaging platform and telecommunications providers), solely so that they can deliver messages on our behalf. These providers are contractually obligated to keep your information confidential and to use it only to provide services to us.
How We Share Your Information
We do not sell or rent your personal information. We may share information in the following limited circumstances:
- Service providers — with vendors who perform services on our behalf, such as tenant-screening companies, payment processors, accounting and property-management software providers (e.g., AppFolio), our text-messaging provider, and IT and communications providers. These providers are obligated to protect your information and use it only for the services they provide to us.
- Property owners and clients — as a property manager, we act on behalf of the owners of the properties we manage and may share relevant information (such as application or tenancy information) with the applicable owner or their representatives.
- Legal compliance and protection — when required by law, regulation, subpoena, court order, or government request, or when we believe sharing is necessary to protect our rights, your safety or the safety of others, or to investigate fraud.
- Business transfers — in connection with a merger, acquisition, financing, or sale of all or a portion of our business, your information may be transferred as part of that transaction.
- With your consent — with other parties when you direct us to or otherwise give us your consent.
Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your personal information, and we limit access to those who need it to perform their jobs. However, no method of transmission over the internet or mobile networks, and no method of electronic storage, is 100% secure. We cannot guarantee the absolute security of your information.
Data Retention
We retain personal information for as long as needed to provide our services, maintain our business records, and comply with our legal, tax, and regulatory obligations. When information is no longer needed, we take reasonable steps to securely delete or de-identify it.
Your Privacy Rights
Depending on where you live, you may have certain rights regarding your personal information, such as the right to request access to, correction of, or deletion of the personal information we hold about you, subject to legal exceptions. California residents may have additional rights under California law, including the right to know what personal information we collect and how it is used and shared, and the right not to be discriminated against for exercising these rights. To make a request, please contact us using the information below. We may need to verify your identity before responding.
Children’s Privacy
Our website and services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will delete it. If you believe a child has provided us with personal information, please contact us.
Third-Party Links
Our website may contain links to third-party websites or services that we do not operate or control. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will post the revised policy on this page and update the “Effective Date” above. We encourage you to review this policy periodically.
